Your function as a Human Resource person, or rather, SHR (Strategic Human Resource) as we present to you throughout, involves much more than just screening potential employees. While as a SHR you may not be considered as an expert on all of the new laws being past, and you may not need to be as familiar as your paralegal counterparts do, but you do need to be aware of certain new ones that can affect how a business is handling their employees. While this article is not a 'white paper' cluttered with a bunch of legislative codes 25 cent language and regulation references, etc., that would qualify this for the Book of the Month club, it is designed to get you thinking creatively. By doing that you can not just be 'up on' the important functions of SHR, as that you'll learn in your courses, but to set yourself apart from the others who aren't. This makes your presence to a company far more valuable, either as staff or through your own servicing SHR business. It shows your not just a professional in your field, but a serious professional.

Two Separate Laws to Add to your SHR Knowledge Base

There are two separate situations, or rather laws, that you need to be aware of and moreover familiar with. One is Safe Harbor and the other the Dynamex Decision by the California Supreme Court. The two are entirely different but both very important. Familiarizing yourself with each will give you our 'Maximum Impact' or an added edge over others who just present themselves as being a 'standard' HR potential. Let's take 'em' one at a time.

Safe Harbor


Safe Harbor laws, as you'll also learn in your SHR classes, protect people and businesses from being responsible for unforeseen mistakes. Another term may be labeled as the 'good faith' law by an act deemed as to not violate the law. These laws give peace of mind to anyone acting in good faith who may otherwise be considered as violating the law for reasons out of their control. Safe Harbor laws cover a considerable range of functions from 401k's to tax liabilities to environmental to health care, especially for 'whistle blowers' with regards concerning safety matters and questionable procedures, and a lot more.

There are some California employers who use what's referred to as a 'piece-rate' compensation system. A new law called in California titled AB 1513 outlines significant changes to how businesses must pay their employees for time they have spent on something referred to as 'non-productive' functions. The Safe Harbor laws can be quite complicated in varying situations, but, it certainly should be on your list to be familiar with. Familiar to the extent that you will know how it applies to employees of a firm you're working for as a Human Resource assistant or manager and 'with' as providing your own SHR / aPHR business servicing a variety of businesses. Showing to a firm in advance that you are familiar with these important changes gives you a big advantage. And this is a good one to add to your Familiarity Bio addendum to your resume we bring up throughout our creative articles.

Now after reading this synopsis you should readily see how this can all apply to functions you'll need to be providing in your SHR career.

Another, more controversial law - The Dynamex Decision

As an SHR you obviously would need to be familiar with the ins and outs, no, not the Hamburger joint, of the worker's compensation laws, but you should also take it upon yourself to be familiar with a new law called the Dynamex decision. This new law changes or modifies how independent contractors are classified and paid, etc., and 'how' this new law applies to workers compensation. Two related matters relate to 'wage orders' and 'labor codes'. California has 17 different Wage Orders based on industry such as manufacturing, public housekeeping, health care and transportation, and they contain slightly different rules according to each respective type of work—from rates paid for minimum/maximum salaries, hours, working conditions, breaks, etc. This all plays into how they're related to all other laws – including the Workers’ Compensation Act (WCA). While this law is a recent one as of late 2018, it does seem quite possible that coalitions will seek to obtain legislative modifications to this law, but for now you need to know its elements as-is, just stay on top of it.
