The Real Estate industry offers considerable
opportunities for a Paralegal with an LDA Certification
to run their own LDP (Legal Document Preparation)
Service Business. Avenues of opportunity can be plenty
and especially for the FSBO (For Sale By Owner) client
as we'll take a look at later.
As a Licensed and
Bonded LDA running your own LDP Service Business you can
provide valuable services to the Real Estate industry
such as providing and preparing the standard legal real
estate contracts, disclosures and deeds required for the
sale of a home, farm or land parcels, as well as all of
the other necessary filing documents required. As an
independent LDA you can market the fact that you can
save thousands of dollars in agent commissions for your
clients while getting professional legal documents, done
right and all ready to sign!
As a Legal Document
Assistant professional you would be authorized to
prepare legal documents and market that you can save
your clients considerable fees.
While there are
limited types of legal document preparation services
that can be performed as an LDP/LDA, there are many
others at your disposal you can legally market. They do
not provide legal advice or represent you in court. An
LDA can only prepare legal documents at the client’s
direction. Laws concerning legal document assistants are
set forth in the California Business and Professions
Code §§ 6400-6415.

Without being annoyingly
redundant, you already know by now that as a Paralegal
and/or a LDA with your own LDP (Legal Document
Processing) business that you're not to legally provide
legal advice. But as a Paralegal doing business as an
LDP you arerequired and, moreover, expected to provide
services that are legitimate and accurate in the filing
of your documents on behalf of your client.
Additionally, since an LDA can only prepare legal
documents at the 'Client's' direction, To ensure you are
in good standing to start your business, Legal Document
Assistant laws can and should be reviewed in the
California Business and Professions Code…and don't
consider this review as being restrictive, but as being
an insurance policy on building and marketing your
business.
Servicing Two Entities at Once
As a Paralegal LDA / LDP, you can provide services to
both Law Firms servicing the Real Estate industry and
Individuals, on contract and/or temporary basis. With
the law firm approach, you have a large pool of law
firms to solicit and their incentive is that they can
actually save money hiring your firm on a temporary or
'As Needed' basis and avoid paying those costly
benefits. So if you're thinking, well wait a minute
here, why wouldn't they have to pay benefits? Well first
off, they would not be your only source of business they
would not be restricting you from marketing to others,
you are in the 'service provider' business or 'work for
hire'.

An Interesting Example
Want an interesting and obscure example of this you
won't find in the law review papers? Years ago the
famous wrestler Jesse Ventura, before he became
Governor, made controversy with the WWF by attempting to
unionize the wrestlers to avoid one or more from being
paid significantly more than the others at various
events and be given benefits. His main beef was that in
one major WWF WrestlleMainia event Hulk Hogan was paid
more than all the other wrestlers combined. Ventura's
attempt was to get them to 'balk' hours before the event
was to take place and force the WWF to agree to the
unionizing demand. What was most interesting and
apparent was that when questioned on the appropriateness
of this action he brought up the fact that while all the
wrestlers were considered as independent contractors
they had been forced to sign contracts that stated they
could only not market their trade wrestling names to any
other organization but more importantly, they were not
allowed to work/wrestle for any other group, thereby
making them soley 'Dependent' on WWF, not 'Independent'.
While the WWF avoided the unionizing as wrestlers
declined, it shook some heads. Therefore, since any law
firm you would provide services to would not be
restricting your access or marketing to 'outside' or
'other' businesses, you would basically be a service
provider.

Sure, since LDAs must register with the County Clerk
in 'Each' county where they intend on providing services
to, you are not restricted to just one county, and
there's a lot of counties,in California to service. So
plan your marketing strategy based on those ADI's (Area

more cost effective to access.

The
Overlooked FSBO Approach
One of the little
thought of categories listed above, FSBO, can provide
some excellent potential for your LDA service business.
A service to the FSBO clients that can be very valuable
to both seller and buyer is that of Property Title
Searches. Title Searches for those FSBO sellers/buyers
selling smaller priced properties and land that may not
necessarily require or be requested to obtain, the
services of the higher priced Escrow Title companies.
While you may not be able to provide the same Title
Guarantee as a Title firm, the owner/buyer may just want
a 'comfort zone' search on the property to ensure there
are no hidden encumbrances or outstanding liens on it. A
basic title search can provide much of that comfort zone
and then some, if you know how to search it. Remember,
the Title firm gets their information at the same place
you would, the County Recorder's office, they're just
set up digitally to find it quicker. But making contacts
and even friends at some of these offices can go a long
way in helping your business run highly efficient and
extremely competitive.
Your services also can
assist the Seller with Counter Offer Forms in those
cases where a potential purchaser may not agree to the
sale terms proposed by the seller. Having the ability to
assist both Buyer and Seller with last minute matters
such as counter offers and the like can speed the sale
process and help avoid conflicting terms of sale.
Realize that the FSBO Seller as well as those
searching for FSBO properties are doing so for several
reasons, some don't trust realtors, some don't want to
jump through all the hoops realtors can sometimes put
you through and most want to save those percentage fees
realtors charge. Plus signing with a realty firm can
often tie up the property you're listing to a lengthy
contract and you can't get nothing done if the realtor
doesn't provide a solid marketing plan and follow
through on it, or just drop the ball, which happens all
the time.
Now don't come back and ask..."but-but-but
hold on Professor, did you leave something out?' Of
course! The whole idea here is to get you thinking

Q:
As a Paralegal working for a law
firm you know that one of your main responsibilities is
to draft client calendars and ensure accurate dates. But
do you know what your/your firm's liabilities and client
recourse is should you mis-calendarize causing the
firm's client to incur an adverse outcome or financial
loss?
A: Any attorney that
uses the services of a paralegal is ultimately liable to
the client for any harm that results from the
paralegal's negligence or misconduct. Put another way,
the duties that an attorney owes to the client are
non-delegable, meaning that it is the attorney who bears
the brunt for mistakes made within the attorney's
office. That being said, no attorney is going to be
happy (to put it mildly) with errors -- especially
calendaring errors -- made by his or her paralegal(s).
The key here is to know not only how to compute dates
(ranging from applicable Statute of Limitations dates to
any relevant transaction dates) but then TO BEAT THOSE
DATES so that things like court filings, discovery
responses, revised contracts and the like are not only
calendared for completion before they are due, but also
sent/filed A FEW DAYS EARLY. How to do this is just one
