PL/LDA in the Independent Documentary/Film Industry "Service
Providing to Short Films to Documentaries to Features
the Opportunites for LDA's!"
by Bob Schott 28
years in Entertainment Industry and Jonathan Arnold, Esq.
Lead Paralegal Academy Instructor
By now many of you have seen our advanced articles on
topics of interest to you, whether you want to secure a
career with a firm or start your own service as a Legal
Document Assistant business. The articles are wide
ranging in topics from general introductions to get you
thinking on unique areas to apply your career, or to
actually focusing on a selected unique category to
consider. This is about one of those unique categories,
applying your Paralegal/LDA career in the independent
documentary and film business. This industry offers
considerable potentials as the indie business doesn't
generally have the in-house legal staff for their
productions to rely on and may of these indie artists
start off with little capital to launch their
productions and need to look for ways to save money. So
let's take a closer look at just some of the many
different potentials in this industry there are to
capitalize on you can market to.
This article is
mainly on starting your own legal document assistant
service as a paralegal and seeking clients from within
this industry but can apply to seeking a career with an
entertainment legal firm as well, especially the smaller
firms. The indie producers have many areas in which they
require all types of filings and research functions and
to give you an idea, let's list a few, before you read
on though, it would be interesting 'for you', if you
stopped here and grabbed a pen and paper and just jotted
down a list of what you 'think' would be applicable
based on what ever degree of knowledge you have about
the indie production field. Obviously, those of you
reading this far have some knowledge as this article has
caught your attention of interest, so make your list
then continue, then compare your list to what you're
about to be introduced to here and see how much or how
little you knew/know that you need to get familiar with.
Unlike the major studio productions with their in-house
staff, lawyers, producers, writers, production equipment
and personnel and of course their mass 'already'
established distribution, P&A (Print and Advertising)
department setups and much more, the indie artist has to
produce everything on their own, usually with a small
group of people whose main credentials are 'desire'.
Many indie producers are a small group of people who
have that desire to see their script idea or even a bare
bones concept on the big screen or broadcast television
networks. But they realize they're working on much
smaller budgets. Even so, they still face the same type
of preparation, production and distribution filings as
the big studios do in order to get there.

ATTORNEYS PROVIDE ADVICE - - PARALEGALS/LDA's
PROVIDE SERVICES - "Certified Paralegals and
LDA's perform legally qualified services as
authorized and afforded to them by law... at the
SPECIFIC DIRECTION OF THEIR CLIENT!"
But before reading
further, there's one big consideration here for you in
your planning stages of your career towards starting
your own business and that is networking with a few
legal and associated resources. In other words find a
good lawyer that knows this industry and see if you can
strike up a working relationship with so you can refer
those more detailed strictly legal necessities to for
your clients on occasion that may be over what you're
legally allowed to provide for your client as a
Paralegal/LDA. Research a good reasonable payroll
payment firm that deals in small businesses, don't go
after the big guys, they handle multi-million dollar
payment and residual accounts, find a smaller firm that
would be interested to work with you on occasion and
enjoy the opportunity to be introduced to new clients.
Research a good insurance company that handles
'Production Insurance', that's the key and get quotes on
the normal policies, a ball park figure of a standard
coverage rider would be $1.5mil rider, these can range
over $1000 a year to over $3000 and for the exact same
coverage, so take your time when researching this one
because if you can offer or suggest to your client an
insurance company that saves them hundreds to thousands
of dollars, you'll certainly be looked on as a valuable
asset service provider. All of this gives you the
appearance of your own turnkey legal and support service
as a document processor. That can be valuable in a sense
that you only need to refer to them when the client
desires or as-needed so there's no cost above your
regular services until or unless you need that
assistance, which the producer may have to rely on at
any rate, unless they're sharp enough to handle this
themselves, and be sure, most 'ain't!'. So let's see
what some of those elements are they'll need to address
in order to get their production going and distributed
and compare 'your' list mentioned earlier to this one.
Here's a Summary list that you'll most likely be dealing
with and need to 'dig' into:
Copyright Filings
Trademark Filings Location Arrangements
Production/Liability and Location Insurance E&O
(Errors and Omissions) Insurance General Rights
acquisitions and release forms
Artist/Talent releases (Non-Union and Union)
Distribution Documentary and Trade Show event
arranging Film Festival arranging Location permits
to film Equipment rental agreements

Good Bad and Ugly of Copyright
Disputes Jonathan Arnold -
Entertainment Legal Expert Ennio
Marricone Copyright Case 8:07
Some Main Examples
While these are just some of the main ones, you can see
there's more forms and filings there in one client - one
place than you'd have with a dozen normal clients only
needing one subject assistance with.
Now if you
want to see why what you're being introduced to here
with our Maximum-Impact articles you wont' find any
where in one place then go ahead and check out some/any
legal document service providers and see how many
address these services or even target this industry.
So, not to just leave you with the 'headers' let's
take a look at just a few some of these on that list
that are most common within the entertainment industry

Trademarks Filing for a
Trademark can be a tricky process as there are numerous
ways you can apply these marks, even with filing a
'Catchphrase', common in the entertainment industry.
Knowing the basic filing process, how to search the
USPTO, filing fees needed, etc. can be a big assist.
When and how to use the 'tm' mark, how to get your 'R'
mark are both important processes you need to be aware
of.
Copyrights Filing single
copyrights, or batch copyrights to save fling fees, what
you can copyright, the necessary forms and process are
all basics you need to be familiar with.
Producers E&O and Production Location Liability
Insurance A most important part for any
production company. Most policies cover the film
producer for the entire rights period granted as long as
there are no changes to the production and are necessary
when arranging and filming on locations as well as in
making acquisition and licensing deals. As mentioned
earlier, having a good resource network for this service
can be a big money saver for the production firm.

Paralegal Calendar
Dates - Recourse and Liability by Jonathan Arnold
Q:
As a Paralegal working for a law
firm you know that one of your main responsibilities is
to draft client calendars and ensure accurate dates. But
do you know what your/your firm's liabilities and client
recourse is should you mis-calendarize causing the
firm's client to incur an adverse outcome or financial
loss?
A: Any attorney that
uses the services of a paralegal is ultimately liable to
the client for any harm that results from the
paralegal's negligence or misconduct. Put another way,
the duties that an attorney owes to the client are
non-delegable, meaning that it is the attorney who bears
the brunt for mistakes made within the attorney's
office. That being said, no attorney is going to be
happy (to put it mildly) with errors -- especially
calendaring errors -- made by his or her paralegal(s).
The key here is to know not only how to compute dates
(ranging from applicable Statute of Limitations dates to
any relevant transaction dates) but then TO BEAT THOSE
DATES so that things like court filings, discovery
responses, revised contracts and the like are not only
calendared for completion before they are due, but also
sent/filed A FEW DAYS EARLY. How to do this is just one
of the important subjects we cover in our Paralegal
program.
