Before we begin illustrating this new potential area in
which you can apply your paralegal career, understand
that this is not all about Patents, it's more about
applying your career to this industry field and it is or
has a twofold purpose. The first is applying your
Paralegal/LDA career seeking a Patent Law firm to work
with, the second is, as we have discussed many times,
applying your Paralegal/LDA career to going into
business for yourself and marketing 'To' Patent Law
firms for outside paralegal outsourcing potentials. And
- the second one brings up a very important marketing
point, or shall I say 'networking' point, that being as
your own PL/LDA service business you or your client,
would need the services of a specialized Patent Lawyer
for the intricate details. Networking attempts to build
your own network of Patent Law firms or individual
patent lawyers, can be most useful for your business as
you can call upon them for the work you can't do as a
paralegal, and since you would refer or network with
them for your client you would then have the luxury of
working 'under' the umbrella of a Patent attorney.
Thereby giving you a full range of services you can
legally provide for your client. Remember, Patent
Lawyers or to become a Patent Lawyer requires one to
pass the Patent Law Bar. So as you can see by
familiarizing yourself well with the Patent process and
filing procedures and also networking with a Patent
Attorney you feel you can have a good working relations
with, you are in part, a specialist yourself. A good
point to remember this specialty field.

Intellectual Filing Costs
Just a side note here that you may find interesting. As
a Paralegal with an LDA certificate note that
intellectual filing fees are different between
copyrights, trademarks and patents. For example,
copyright fees can average between $40-$100, trademark
fees between several hundred to the low thousands,
patents can range between $10,000 to $30,000+. So as you
can see, patents are also a high price category of
business. They also in general, have a longer time
period from filing to acceptance to the grant of the
patent, so keep all that in mind.
Patent
Law - Under the IP (Intellectual Property) Umbrella
Patent law is considered, along with Copyright and
Trademark law, as a key part of intellectual property
law, and controls what inventions qualify for patents,
the patent application process, and how patent
infringement is handled.
Patent law is a category
separate from Copyrights and Trademarks in all other
aspects. Inventors seeking legal protection for
inventions, need to have a good understanding of the
basics of patent law before they go too far into their
development stages. It is also beneficial to have some
knowledge of overall intellectual property law, the
background of patent law, it's requirements that an
invention must meet before it qualifies for a patent,
and some of the issues that make patent law difficult to
navigate. Also, all Patents are filed with the USPTO
(United States Patent and Trademark Office). The rules
for drafting and filing a patent application are set out
in the Manual of Patent Examination Procedure (or
"MPEP"). There you can find a great deal of useful
information as you strategize your career application
into this field.
Interesting Quick Sand Traps to Be Knowledgeable
About
A good patent attorney can help
the inventor protect themselves against “Patent Trolls”,
a bit of quick sand in the road to a Patent. Sometimes
the Patent system allows companies to get patents they
are not actually entitled, then turn around and actually
use those patents to sue other companies who are
actually working in that area! Most often than not
they're 'shell' corporations set up for the express
purpose of unethical purposes. They then file a plethora
of extremely vague and obscure patents hoping to get a
few approved or buying up other vague patents then use
those worthless patents to sue other smaller companies
they don't think have the resources for solid legal
representation hoping for some sort of settlement.
Filing a suit against them can be quite expensive and
very lengthy in their effort to prove that the suit has
no business being filed in the first place. Since they
don't produce 'anything' their liability is close to
zero.
What about International protection: Well,
that's a bit of a mess, as there is no one single patent
regime which will protect you worldwide. There are
multiple different regional patent offices (such as the
EPO which protects patents as between North America and
the EU), and many more specific country patent offices,
each one only protecting the rights in specific areas. A
lousy problem: The nasty fact is that a patent in the
USA, which gives details on how your technology works,
may actually be showing someone in another country how
to copy the idea without fear of legal recourse, as your
idea may not be protected in their country.
So

country. So if the inventor wants worldwide protection,
then they would need to work with legal firms in each
country / region they desire protection in. This adds to
another 'Network' aspect you can consider to expand your
career and marketing impact, or as we say 'Give You
Maximum-Impact'.
The Basics of a Patent
A patent
provides a property right giving the inventor the legal
protection in the way of being able to stop others from
making, using, or selling an invention for a designated
amount of time. But, if seeking to apply your
Paralegal/LDA career in this law category is your desire
then you probably are aware of at least that much. If
not, you need to familiarize yourself with the basics
ahead of time.
Additionally it is wise to
understand that while Patent law falls under the IP
(Intellectual Property) area, do not confuse it with
Trade Secret Law, and that one can be a real can of
worms at times as it deals with functions, formulas,
equipment/technology etc. and the protection from
'leaking' and so on and so on.
In many of our
previous articles on Paralegals/LDAs in the
Entertainment Industry and the Music Industry we discuss
how applying your PL career to this field can present
many opportunities such as assistance with Copyright and
TM filings. Patent Law gives you another avenue to
pursue if that's your interest as there are no shortage
of inventions and designs on the market opening up a
wide range of marketing opportunities.
Patentable
subject matter must be involved. While it is not the
purpose of this article to give a text book course on
the inner workings of all things having to do with
patents, a good general way to classify this would be to
simply say the invention must be 'Useful', not
'Useless'. It also must be Unique and 'Non-Obvious' and
that one covers a great deal of area by itself. And then
there are a series of patentable categories that
qualify. Again, as a Paralegal/LDA this is where your
Familiarization strategy comes in, 'know your industry
you're pursuing!'
Familiarizing and Marketing
As mentioned, whether you apply your Paralegal/LDA
career to a Patent Law firm or start your own PL/LDA
business, two very important elements are Familiarizing
yourself with Patent law and Marketing to yourself to
the firms or your business to the inventors and the
firms. Many of our articles include and stress the

your strong suit when it comes time to approach your

and that should be your main focus.

out with an IP (Intellectual Property) protection or
Patent of some sort at some time, and yes, even possibly
the 'design' of the technology as well as many patents
are based on variations of patents that preceded them.

Q:
As a Paralegal working for a law
firm you know that one of your main responsibilities is
to draft client calendars and ensure accurate dates. But
do you know what your/your firm's liabilities and client
recourse is should you mis-calendarize causing the
firm's client to incur an adverse outcome or financial
loss?
A: Any attorney that
uses the services of a paralegal is ultimately liable to
the client for any harm that results from the
paralegal's negligence or misconduct. Put another way,
the duties that an attorney owes to the client are
non-delegable, meaning that it is the attorney who bears
the brunt for mistakes made within the attorney's
office. That being said, no attorney is going to be
happy (to put it mildly) with errors -- especially
calendaring errors -- made by his or her paralegal(s).
The key here is to know not only how to compute dates
(ranging from applicable Statute of Limitations dates to
any relevant transaction dates) but then TO BEAT THOSE
DATES so that things like court filings, discovery
responses, revised contracts and the like are not only
calendared for completion before they are due, but also
sent/filed A FEW DAYS EARLY. How to do this is just one
of the important subjects we cover in our Paralegal
