Understanding Maritime Law or Admiralty Law

First off, Maritime Law (also known as Admiralty Law), governs maritime activities and offenses in this vast high-seas category, Maritime law is a part of international law formed by the different law-makers under the International Maritime Organization (IMO) where they develop the convention that later often becomes the statute law of the countries, ie; the Law of the Seas Conferences.

The maritime industry provides potentials for not just jobs, but high-skill, high-paying careers, and Careers are what you'll have here from LAVC. Maritime law is considered by many as one of the most complex but highest paying fields in law. A geographical opportunity awaits you here at LAVC as there is an enormous array of organizations, firms and industries filled with career potentials right in your own backyard of the West Coast. From Los Angeles to San Diego there is much maritime activity. The Port of Los Angeles ranks as the #1 container port in the United States. San Diego hosts one of the world's largest oceanographic centers, Scripps Institution of Oceanography, and countless more unique organizations and law firms. One quick scan of legal resources on Justia of the numerous maritime attorneys in Los Angeles alone reveals the abundance of opportunity right here in your own area, the Pacific West Coast.

A Maritime Historical Brief to Highlight the Potential Opportunities

Try to see the many opportunities stemming from this field of where you can apply your PL and LDA career that come to mind. This applies to landing a great position at a firm and working your way up, or going it alone with your own PL/LDA consulting/processing service.

All Aboard? Good. Realize that the historical development of ships directly supported the development of mankind as they eventually became integral parts of people's daily life and every day business. Ships were a major factor in explorations and scientific and technological developments in history. Fast forward to today and you can safely say ships are the single most factor to Maritime Law that enable world trade and shape the world's economy. An offshoot of basic history of Maritime Law applies to the topic of coastal country boundaries that go back to the days of Pirates and even further. In those days a 3 mile limit existed for global countries as 3 miles was as far as a canon could shoot to defend their boundary. Later on it was extended to 12 miles, then 50 miles and now the established 200 mile limit 'or' the area of a country's own continental shelf and that's a key - 'or'. There are other complicated laws the continental shelf law was designed to address, with of course some variants. Variants such as considering the Key West Florida distance of 90 miles to Cuba, as adjustments in the 200 mile limits exist in many areas today. A tricky subject of Maritime Law incident was an embargo blockade that almost caused World War III in the early 1960's between Russia and the United States, ask your parents or grandparents about that one. Maritime Law gets complex by two basic elements, the surface waterways and right–of-passage on the high seas, and the deep sea-bed or sub-surface business interests. But until recently in the1900's there was virtually no company with the ability to mine the ocean's vast resources of the deep as there was no technology capable of retrieving the mineral rewards that lie beneath.

Both sea surface and sub-surface sea-bed factors present multiple areas of Maritime Law opportunities for you. In the mid 1970's the United Nations held a rather lengthy Third World Law of the Seas (TWLOS) Conferences with various intents and purposes. The U.S. 'proposed' numerous bills, such as HR 3350, having to do with the protection of our oceans resources and a global agreement on who shall benefit from these deep sea-bed resources. Since there were only a handful of shipping companies that were equipped to recoup mineral resources that of course would leave many countries out.

Without going into quite lengthy and argumentative conference details, two factors resulted, the Law of the Seas U.S HR 3350 and support proposed bills, that never passed, and the fact that the TWLOS of the 70' ended with the UN adopting a treaty but the US and other countries rejecting it. Nations Business Magazine in 1978 covered this topic in detail and boldly revealed that "The seabeds contain a treasure trove of metals that mankind needs. Business wants to bring up the treasure and make a fair profit. Many UN delegates don't want it that way."

When the conference fighting ceased and the smoke cleared the rooms, one clear message was left standing, that being that the oceans of the world are declared as the 'Common Heritage of Mankind'. However, this was and is today more of a diplomatic 'cool' sounding slogan than a solid defensible law that is constantly challenged, as... 'what about the 'Deep Sea-Bed?'. Starting to see opportunities in Maritime Law yet?

So what does this history have to do with seeking out a Maritime career? Plenty, as you must consider the extreme sought after value of the Ocean's great deep sea-bed resource deposits and the vast primary and support industries that are heavily engaged in our ocean's business. The control of the Deep Sea-Bed resources and shipping are but two of a more complex law business. Dive deeper and you'll see, there are many law factors that come into play, such as Flagship laws, ocean surface right-of-passage, deep sea-bed mining, port trade tariffs, international negotiations, mineral extraction rights, environmental issues, boundary issues, 'who took what from where and how much' etc., and on and on. Therein lies a great deal of opportunities for a career in the Maritime (Oceanographic) Industry that are far too vast to 'dive' too deep into here, so we'll just get your feet wet in this introduction and now take a look into a little more clearer waters.

Maritime Categories Abound with Sub-Category Opportunities

As with many of our unique articles on various subject topics, this is not intended as an industry directory or case law white paper. In our Paralegal Program we get you started with the underlying basics to all forms of trade and transportation: Contract Law – where we cover commercial contracts, basic shipping terms (and provide a working introduction to the internationally used INCOTERMS®) and insurance. So as mentioned, the maritime industry is made up of all categories of businesses relating to the many sub-categories such as; transportation of goods and people over major waterways, including cargo shippers, cruise lines, ferries, shipbuilders, deep sea-bed mining companies, oceanographic research centers, environmental for-profit and non-profit organizations, military operations, maritime law firms, and more. But...also realize that these careers don't just include primary sea-based positions; the maritime industry also employs countless land-based support operations as well. A side note opportunity perhaps appears with the numerous ocean Environmental Organizations and Groups that would probably find great value in bringing on their own PL/LDA to help them with all their legal-cause actions, and that is a vast one if you're an active environmentalist that cares about, and realizes, the need for the preservation, protection and valuable resources of our seas. Now what does that bring to mind? Exactly, less competition than your standard 'cattle call' job offer at a personal injury firm only filling out insurance forms all day. Starting to see how this industry contains some unique and potential career opportunities relating to it with 'Waves' of layers that just keep going? A Potentially interesting and rewarding diversion from normal day-in day-out fields of law.

Now after just laying out some highlights of this complex but highly rewarding field and by you researching each category and sub-category you'll see how an entire career opportunity has opened up right in your own backyard.
